What the law actually says

Two things trip most people up

Federal Decree-Law No. 33 of 2021 replaced the old labour law in February 2022, and two assumptions people still carry from before that date are usually the source of a wrong number.

  • Basic salary only. Housing, transport, and other allowances do not count, even though they might be most of what lands in your account. This alone can shrink the number well below what a total-salary guess would suggest.
  • Resignation and termination now pay the same. The old limited-versus-unlimited contract system, and the reduced gratuity for resigning early, were both abolished with the 2022 law. Every contract is fixed-term now, and how the employment ended no longer changes the calculation.
  • Under a year is zero. The one-year minimum is a hard cutoff, not a proration starting point.
  • Payment is due within 14 days of the contract ending, under the same law.

Using total salary instead of basic

If your offer letter splits pay into basic plus allowances, only the basic figure goes into this calculation.

Worth knowing

The old resign-vs-terminate rule is gone

If you've read that resigning early forfeits part of your gratuity, that was true before February 2022 and is not the current law.
